EMENTA: APELAÇÃO CÍVEL - PLANO DE SAÚDE - CINTILOGRAFIA - AUSÊNCIA DE EXPRESSA EXCLUSÃO CONTRATUAL - CONTRATO ANTERIOR À LEI N.º 9.656/98 - MIGRAÇÃO DE PLANO DE SAÚDE PARA OUTRO ADAPTADO AO NOVO REGRAMENTO - FALTA DE INFORMAÇÃO AO CONSUMIDOR. - Inexistindo cláusula expressa de limitação de cobertura de procedimento pretendido e não tendo o consumidor sido informado acerca da possibilidade de optar por adaptar, à Lei n.º 9.656/98, o contrato por ele firmado, não deve prevalecer a recusa da operadora do plano de saúde.
