EMENTA: APELAÇÃO CÍVEL - AÇÃO DE INDENIZAÇÃO POR DANOS MORAIS - INCLUSÃO INDEVIDA NO CADASTRO DE INADIMPLENTES - INEXISTÊNCIA DE DÉBITO - INSCRIÇÕES PREEXISTENTES - SÚMULA 385 DO SUPERIOR TRIBUNAL DE JUSTIÇA - NÃO CABIMENTO DE DANOS MORAIS - SENTENÇA MANTIDA. 1. É pacífico o entendimento de que a simples inclusão indevida gera o direito à indenização por danos morais. 2. Quanto ao dano moral, não há como afastar a incidência da súmula 385 do STJ, porque não restou comprovado que as inclusões pré-existentes foram ilegítimas.
